Important Ruling on Driving Without a License: What It Means for Islamabad Drivers
Recently, the Islamabad High Court made a significant decision that affects all drivers in the city. Chief Justice Sardar Muhammad Sarfaraz Dogar ruled that authorities cannot register cases against citizens who are caught driving without a license on their first offense. Instead, drivers will receive a warning and a fine.
This ruling came after an individual, Muhammad Abi Hassan, challenged the existing practices of law enforcement. He argued that according to the Motor Vehicle Ordinance, the penalty for driving without a license should not extend beyond a fine. Arresting individuals or confiscating their vehicles, he claimed, was out of line with the law.
The conversation in court highlighted an important distinction: while driving without a license can result in severe consequences if an accident occurs—potentially leading to murder charges—ordinary circumstances should be treated more leniently. Chief Justice Dogar noted that given Pakistan’s long history, drivers should be well aware of the necessity of having a valid license.
Interestingly, during the proceedings, the Chief Traffic Officer (CTO) of Islamabad, Captain (retd) Hamza Humayun, assured the court that no cases had yet been registered against drivers without licenses, despite initial threats. He also mentioned plans for a digital system that could help verify licenses, similar to the CNIC feature on the NADRA app, making it easier for citizens to prove their qualifications on the go.
Ultimately, the court emphasized the importance of not creating unnecessary criminal records for first-time offenders. The decision aims to promote responsible behavior while also considering the rights of citizens. Individuals who repeatedly disregard licensing regulations, however, may face stricter penalties down the line.
