Mizan Beverages Fined for Mimicking PepsiCo’s Sting: A Lesson on Brand Integrity

In an interesting twist in the beverage world, the Competition Commission of Pakistan (CCP) recently slapped Mizan Beverages (Pvt) Ltd with a hefty fine of Rs150 million. Why? The company was accused of copying the packaging and branding of PepsiCo’s popular energy drink, "Sting."

The product in question, Mizan’s "Storm," reportedly mimicked Sting’s overall design—everything from the color combination to the bottle shape was eerily similar. The CCP classified this act as parasitic copying, which falls under the umbrella of deceptive marketing practices prohibited by the Pakistan Competition Act of 2010.

So, what does that entail? Section 10 of the Act is quite clear: it bans any form of deceptive marketing that could mislead consumers or harm the interests of other businesses. This includes spreading false information or using someone else’s branding for gain.

PepsiCo originally lodged its complaint back in 2018, claiming that Mizan designed "Storm" to ride on Sting’s coattails, unfairly benefitting from PepsiCo’s hard-earned reputation. Instead of addressing these claims, Mizan attempted to stall the inquiry through legal maneuvers, seeking injunctions that delayed the investigation for years. However, the Lahore High Court eventually dismissed Mizan’s appeals, allowing the CCP to move forward with its inquiry.

The Commission’s ruling was quite damning. It pointed out that Storm’s bold red color scheme, its slanted white lettering, and overall bottle shape could easily confuse consumers. Even though Mizan had a registered trademark for "Storm," this didn’t exempt them from competition laws aimed at preventing consumer deception.

Dr. Kabir Sidhu, the chairman of the CCP, made it abundantly clear that copying other brands and using misleading packaging won’t be tolerated. Regardless of the company’s size, the law aims to keep things fair in the marketplace, and strict action will be taken against those who violate it.
