Election Tribunal Dismisses Petition, Confirms PML-N Victory in Peshawar
In a significant ruling last Monday, an election tribunal in Peshawar, led by Justice (R) Lal Jan Khatak, dismissed the election petition filed by Taimur Saleem Jhagra, the Pakistan Tehreek-e-Insaf (PTI) candidate for PK-79 (Peshawar 8). The tribunal confirmed the victory of Pakistan Muslim League-Nawaz (PML-N) candidate Jalal Khan in the recent provincial assembly elections.
Jhagra’s case centered around discrepancies he believed occurred during the election process. He claimed to have secured a substantial majority, according to Form 45, but was declared the loser under Form 47, which showed that Khan had fewer votes. He alleged that the election was marred by rigging and manipulation, asserting there was clear evidence in the official records backing his claims.
During the proceedings, Barrister Yaseen Raza, representing Khan, argued that Jhagra’s petition contained multiple legal inaccuracies. Raza pointed out that Jhagra failed to meet important legal criteria vital for an election petition, which ultimately complicated the verification process. In a notable error, Jhagra incorrectly listed his father’s name in his affidavit, which further weakened his case.
After carefully considering the submissions, the tribunal concluded that Jhagra’s election petition lacked sufficient merit and did not adhere to the required legal standards. As a result, they upheld Khan’s victory, reinforcing the decision of the electoral body.
The dismissal of this petition underscores the complexities of electoral processes and the rigorous standards candidates must meet to contest election results. For many followers and supporters of both parties, the developments serve as a reminder of the ongoing political dynamics in the region.
