Understanding the Lahore High Court Ruling on FIRs and Acquittals

In a significant decision, the Lahore High Court (LHC) has ruled that continuing to reference a First Information Report (FIR) against someone who has been acquitted is not just unfair but also violates that person’s dignity and fundamental rights. This judgement is crucial in understanding how the legal system protects individuals after they have been cleared of charges.

Justice Abher Gul Khan emphasized that once a court has acquitted an individual, public authorities must not associate that person with the case any longer. This ruling is particularly important because it reaffirms the fundamental principles of fairness and the presumption of innocence, which should be upheld in our judicial system.

The case in question was brought forward by Abdul Rehman Faryad, who faced challenges due to his FIR being mentioned in documents that were supposed to certify his character. Despite being cleared of kite flying charges in court, he found that this mention negatively impacted his ability to travel overseas. It’s alarming how something like this can shadow someone’s reputation long after they have been exonerated.

After multiple attempts to rectify this via the Home Secretary and an eventual contempt petition, the LHC stepped in. The authorities argued that the FIR must be preserved per police rules, which led to the conclusion that his record status was updated. However, the court deemed that internal record-keeping should not infringe upon an individual’s rights. Justice Gul succinctly pointed out, “Once an accused has been acquitted…he is to be considered, in the eye of the law, entirely absolved of the allegations."

Ultimately, the court ordered that a new police character certificate be issued to Faryad without any references to the FIR, ensuring it accurately reflects his acquittal. This ruling serves as an important reminder about the need for justice and fair treatment in the legal system.

The importance of such rulings extends beyond just legal jargon; they resonate on a human level.
